By commissioning me, you agree to have read and accepted my TOS. All commissions are digital goods, meaning I will never ship out anything physical to you. The digital goods will be sent to you via VGen or email. All commissions are created for personal/private use by the commissioner unless specified otherwise, and may not be used for personal profit, distribution, commercialization, monetization, NFT or AI training of any kind. I hold the rights to the artwork, but the commissioner holds the rights to the content and/or the characters drawn.PAYMENT
Payments are due upon accepted requests via VGen.Payments due up front and in full unless specified in the commission category.If prices change in the future, the client pays for the original price of their artwork + fees if applicable.CHARGEBACKS & REFUNDS
I do not allow any chargebacks under any circumstances. I will refund the money to the client if we cannot come to an agreement after the sketch phase or if I can not deliver the finished product for whatever reason. I as the artist, have the right to decline a commission for any reason.COPYRIGHT AND CREDITING
The client is responsible of making sure they hold the rights of ownership of their characters. Meaning the client will not use stolen characters or designs to commission me. I reserve the right to post my work on social media with credits to the client (unless NDA is applied). The client has to credit me as the artist in case the client posts my work publicly.USAGE AGREEMENT
The commissioner may display or use their commission on any of their personal sites for things such as icons and banners as long as its not used commercially. Commercial commissions may be offered through select commission types, and can incur an extra commercial fee. Streaming/Content use assets already include commercial fees.Any commissions that do not come with a commercial license are forbidden to be used commercially, meaning the client is not allowed to reproduce and sell my artwork, or use it on websites to advertise yourself for profit (e.g. YouTube, Twitch, Patreon etc.)A commercial license can be purchased and is usually x2 the original price, but may change depending on the circumstances and commission type.Even after receiving a commercial license to my artwork, I still retain all rights to my work and I am allowed to post it on my social media to advertise myself and the client still has to credit me for it.The commissioner is welcome to print a physical copy of their commissioned artwork for their personal use only, it is prohibited to resell any of my artwork.NON DISCLOSURE AGREEMENT (NDA)
I retain the right to post any commission I work on on social media, unless the client wishes to pay an NDA fee. Meaning I will refrain from posting anything about the client's commission until after their debut or until the client gives me their ok. The client still needs to credit me for my work even with a NDA license purchased.REVISIONS
Revisions are available unless specified within the commission type. All revisions made during the sketch phase are free of charge. If the client cannot come to an agreement during the sketch phase they are refunded in full.Clients are allowed up to 3 free minor revisions after the sketch phase or upon final delivery of a commission if applicable. If more edits are needed fees will apply. Fees automatically apply to major revisions upon final delivery.DEADLINES AND DELIVERY
Deadline or rush commissions are available and will take high priority over non-deadline commissions. Fees apply for priority commissions. Deadline fee prices depend on how tight the deadline needs to be. Commissions will be delivered through email or through the VGen commission services unless specified otherwise. Commission deliverables dependent on commission type. Please see individual commission for timelines.
